Terms and Conditions

1.      Information and instructions on how to enter this promotion and claim a personalised backpack, lunchbag or clothing stamp valued at A$50.00 more fully described in clause 9 (“Redemption Offer”) form part of these Terms and Conditions. By participating in this promotion including by claiming the Redemption Offer, the claimant will be deemed to have accepted these Terms and Conditions and agreed to be contractually bound by them. Redemption Offer not valid in conjunction with any other offer, unless otherwise advised.

2.      This Promotion is only open to Australian residents. Employees and their immediate families of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3.      Claimants under 18 years old must have the approval of their parent or guardian to claim and further, the parent/guardian of the claimant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor submitting a claim in this promotion. If an eligible claimant of the Redemption Offer is under the age of 18 years, the Redemption Offer will be awarded to the eligible claimant's nominated parent or guardian on the eligible claimant’s behalf.

4.      To be eligible to claim the Redemption Offer, an eligible individual must purchase a FUJIFILM instax SQUARE Link “For Moments that Matter” bundle (“Eligible Product”) from an authorised Australian participating dealer/retailer listed on www.instax.com.au/pages/where-to-buy during the period commencing 8 December, 2025 and ending 11.59pm AEDT 31 January, 2027 (“Promotion Period”). For the avoidance of doubt, this promotion does not apply to any FUJIFILM products other than the FUJIFILM instax SQUARE Link “For Moments that Matter” bundle which references this Promotion on the outer packaging and contains inside the bundle a voucher with a unique code in order to redeem the Redemption Offer via the FUJIFILM Photos website at www.fujifilmphotos.com.au/instax-bts-2026. Only one (1) item may be redeemed for each unique voucher code. The Promotion is only available while stocks last.

5.      To claim the Redemption Offer, eligible claimants must go to www.fujifilmphotos.com.au/instax-bts-2026, create an account (if they do not already have a FUJIFILM Photos account) and follow the instructions to submit their claim to the Promoter including selecting their chosen Redemption Offer and entering their unique voucher code at checkout. The Promoter will only accept Redemption Offer claims received from claimants on or before 11.59pm AEDT on 31 JANUARY, 2027, in relation to an Eligible Product purchased during the Promotion Period. The Promoter reserves the right to extend the Promotion Period, or the deadline for making Redemption Offer claims. CLAIMAINTS SHOULD NOTE THAT THE COST OF DELIVERY OF THE REDEMPTION OFFER IS TO BE BORNE BY THE CLAIMAINT. THE DELIVERY COST MUST BE PAID FOR BY THE CLAIMANT AT THE TIME OF CHECKOUT.

6.      The information that must be provided by claimants in the claim process includes: (a) personal and contact details, including full name, phone number, email address, postal address; (b) the unique voucher code; and (c) delivery address to receive the Redemption Offer (PO Boxes not accepted).      

7.      Each eligible claimant may only claim one (1) of the items listed in clause 9 per unique voucher code.

8.      Claimants are requested to allow up to 14 days after submitting their claim online for the delivery of the Redemption Offer.

9.      The Redemption Offer is a choice of ONE (1) only of the following items each valued at A$50.00:

·        6L personalised backpack (34cm H x 23cm W x 8cm D); OR,

·        Personalised lunchbag; OR,

·        Personalised clothing stamp,

each personalised with name or details.

 

10.   Claimants must retain a copy of their original receipt(s) for all Eligible Products as proof of purchase. Failure to produce the proof of purchase for all Redemption Offer claims when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of a claimant’s Redemption Offer claims and forfeiture of any right to the Redemption Offer. Purchase receipt(s) must be in the form of a valid Australian tax invoice, as defined by the Australian Taxation Office. In the event a purchase receipt is not automatically handed to the claimant by a staff member, it is the claimant’s responsibility to request one. Purchase receipt(s) must clearly specify the participating dealer/retailer and that the purchase was made during the Purchase Period but prior to claim submission.

11.   Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

12.   The Promoter reserves the right to verify the validity of claims and reserves the right to disqualify any claimant who the Promoter reasonably believes may have tampered with the claim process or submitted a claim which is not in accordance with these Terms and Conditions. Claims will not be valid in the event that a claimant’s purchase of an Eligible Product is refunded. In the event that an Eligible Product is replaced with another Eligible Product by the participating dealer/retailer, no claim may be made in respect of the replacement receipt.

13.   If the Redemption Offer is unavailable for any reason, the Promoter reserves the right to substitute the Redemption Offer with another reward of equal or greater value and/or specification.

14.   Redemption Offer is not exchangeable or transferrable and cannot be taken as cash unless specified otherwise. 

15.   If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

16.   Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

17.   Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

18.   Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Redemption Offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the Redemption Offer.

19.   All claims become the property of the Promoter. The Promoter requires claimants’ personal information in order to conduct this promotion. If the requested information is not provided, then the claimant cannot participate in the promotion. The Promoter will use and handle the claimants’ personal information as set out in its Privacy Policy (which can be viewed at www.fujifilm.com/au/en/privacy). In addition to any use that may be outlined in the Promoter’s Privacy Policy, by making a claim, unless otherwise advised by the claimant,  each claimant consents to the personal information they submit with their claim being entered into a database and the Promoter may use this information for an indefinite period in any media for future promotional, marketing and publicity purposes including sending electronic messages or telephoning the claimant, without any further reference or payment or other compensation to the claimant. A request to access, update or correct any information should be directed to the Promoter’s Privacy Officer (Postal Address: PO Box 63, North Ryde BC, NSW 1670 - Email: ffau.privacy@fujifilm.com). The Privacy Policy also contains information about how claimants may opt out, access, update or correct their personal information, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.

20.   The Promoter’s decision is final and no correspondence will be entered into.
